Welcome to The epic cake. These Terms of Service ("Terms") constitute a binding legal agreement between you ("User", "Client", or "You") and The epic cake, an entity operating under the laws of the Commonwealth of Puerto Rico ("We", "The Company").

By accessing, installing, or using any of our websites, Discord bots (e.g., ARAID, Helper+), control panels (dashboards), APIs, or related services (collectively, the "Services"), you agree to be bound by these Terms.

1. License to Use and Intellectual Property

1.1 License Grant: Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services for your personal use or internal community use.

1.2 Ownership: All rights, title, and interest in the Services, including but not limited to: source code, algorithms, visual interfaces, trademarks ("The epic cake", "TECIA"), and content created by us, are the exclusive property of The epic cake.

1.3 Restrictions: You may not: (a) reverse engineer, decompile, or attempt to extract the source code of our Services; (b) resell, sublicense, or distribute our Services without written authorization; (c) use the Services to train Artificial Intelligence models without consent.

2. Data Collection and Usage Metrics

To continuously improve our products and offer a personalized experience, you authorize The epic cake to monitor and analyze your use of the Services.

2.1 Telemetry and Analytics: We reserve the right to collect technical, behavioral, and performance data in real-time. This includes, but is not limited to: response times, command usage frequency, interface interactions, system errors, and navigation patterns.

2.2 Data Usage: The collected information will be used for infrastructure optimization, research and development (R&D) of new features, security, and commercial statistical purposes.

3. Payments, Refunds, and Subscriptions

3.1 Processing: Payments are processed by third parties (Stripe, PayPal). We do not store your full financial information.

3.2 No Refund Policy: Due to the digital and intangible nature of our products, all sales are final. We do not offer refunds for "change of mind" or subjective dissatisfaction, unless required by applicable law.

3.3 Chargebacks: Any attempt to initiate a fraudulent chargeback will result in the immediate termination of your account and a permanent ban from all our Services (global blacklist).

4. User Conduct and Acceptable Use

You agree not to use the Services to:

Violate the Terms of Service of third-party platforms (specifically Discord and Roblox).
Perform Denial of Service (DDoS) attacks, spam, or distribute malware.
Host or promote illegal content, child pornography, or hate speech according to the laws of Puerto Rico and the United States.

5. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE EPIC CAKE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

6. Limitation of Liability

IN NO EVENT SHALL THE EPIC CAKE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA OR PROFITS), ARISING OUT OF THE USE OF THE SERVICES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS.

7. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Puerto Rico. Any legal dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the state or federal courts located in San Juan, Puerto Rico.
